1. Notice to Site Visitors

BY USING THE SITE AND PARTICIPATING IN THE SERVICES OFFERED ON THE SITE OR AVAILABLE THROUGH THE SITE’S APPLICATIONS, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO THIS PRIVACY POLICY, AND YOU CONSENT TO OUR COLLECTION, USE AND DISCLOSURE OF YOUR INFORMATION AS DESCRIBED BELOW.

THIS PRIVACY POLICY IS INCORPORATED INTO AND IS SUBJECT TO THE TERMS OF OUR TERMS OF USE AGREEMENT. THIS PRIVACY POLICY DESCRIBES THE DATA PROTECTION PRACTICES OF SPEEDY HEALTH INC. WE ARE COMMITTED TO RESPECTING THE RIGHTS AND CHOICES OF THE USERS OF OUR SITE, WHICH YOU CAN MANAGE, UPDATE AND REQUEST TO DELETE THE INFORMATION. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, PLEASE DO NOT USE OUR SERVICES.

2. Non-personally identifying information

Like most website operators, we collect non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Our purpose in collecting non-personally identifying information is to better understand how our visitors use the Site. From time to time, we may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of the Site. We also collect information that may be personally-identifying like Internet Protocol (IP) addresses for logged in users and for users leaving comments on the Site. We only disclose logged in user and commenter IP addresses under the same circumstances that we use and disclose personally-identifying information as described below.

3. Personally-Identifying Information (“PII”)

Certain visitors to the Site choose to interact with us in ways that require us to gather PII such as your name and contact data like your email address, phone number, billing and postal address (including zip code), as well as demographic data such as your gender, date of birth, height and weight. The amount and type of information that we gather depends on the nature of the interaction. Those who request services, products, or related guidance are asked to provide additional information, including, as necessary, the personal and financial information required to provide those services, products, or guidance.

In each case, we collect such information only insofar as is necessary or appropriate to fulfill the purpose of the visitor’s interaction with us including, but not limited to, confirming and tracking services, product orders, and order histories. We will collect this information as you navigate our site from your web browser, mobile device, when you make payments through our site and when you contact us.

We do not disclose PII other than as described herein. Visitors can always refuse to supply PII, with the caveat that it may prevent them from engaging in certain Site-related activities and receiving services, products, and related guidance.

4. Protected Health Information (“PHI”)

We will work closely with third parties and third party intermediaries to provide you with our services, e.g. physicians, medical professionals, pharmacies, pharmacists, hospitals, other healthcare organizations, insurance organizations, merchant banking facilities, as well as with advertising networks, analytics providers, marketing partners, social media and other content platforms as well as search information providers. Such third parties sometimes provide us with additional information about you. As an online telemedicine company, sometimes this information is classified as PHI under the Health Insurance Portability and Accountability Act 1996, Public Law 104-191, and its related regulations and amendments made from time to time (“HIPAA”).

When using our site and services you will provide certain health and medical information that may be protected under HIPAA. We will not sell any PHI in violation of HIPAA. We will maintain the privacy of PHI as required by law and we will not use or disclose PHI without your consent unless it is an emergency or you fall ill and require hospitalisation. Any PHI shared with the emergency services will only be necessary and in your best interests, and this will extend to any potential threat to yourself or others.

5. Protection of PII and PHI

We take measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of PII and PHI. We disclose PII and PHI only to those of our employees, contractors and affiliated organizations that (i) need to know such information in order to process it on our behalf or to provide services available at the Site, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of your home country; by using the Site, you consent to the transfer of such information to them.

We will not rent or sell PII or PHI to anyone, provided however that any entity acquiring our business, regardless of how such an acquisition is structured, will have the right to continue utilizing all PII and PHI provided to us without requiring your additional consent. Other than to our employees, contractors, acquirers, affiliated organizations, as described above, we disclose PII and PHI only in response to a subpoena, court order or other governmental request, or when we believe in good faith that disclosure is reasonably necessary to protect our property or rights or the property or rights of third parties, the public at large or as otherwise required by law or regulators.

6. Aggregated Statistics

We may collect statistics about the behavior of visitors to the Site. We may display this information publicly or provide it to others. However, we do not disclose PII other than as described herein.

7. Cookies

A cookie is a string of information that a website stores on a visitor’s computer and that the visitor’s browser provides to the website each time the visitor returns. We use cookies to help us identify and track visitors, their usage of the Site, and their website access preferences. Our visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using the Site, with the drawback that certain features of the Site may not function properly without the aid of cookies.

8. Marketing Purposes and Your Rights

We will not disclose your personal data or profile data for marketing purposes of our own or of third-parties, unless you specifically and explicitly consent. We are not responsible and do not have any control over any third party privacy practices. If you consent to any such disclosure, you may withdraw your consent for future disclosures at any time, although any such withdrawal would not affect any data disclosed or shared before the change was processed.

You have the right to block, reject, disable, delete or change these settings at any time. You also have the right to inspect, copy, change or remove your PHI. You have the right to instruct us not to contact you through your PII. If you are a California resident, the California Consumer Privacy Act (“CCPA”) applies on how we collect, use and or share your PII. We must inform you about the categories of PII we collect and the purpose for obtaining this PII; it also includes to whom and why we disclose your PII and PHI. The CCPA also provides you with the right not to be discriminated against. If you wish to exercise any of your rights, please contact us on the email address: [email protected].

9. California “Do Not Track” Disclosure

California law requires websites to explain certain online practices regarding tracking of visitors. Some web browsers have a “Do Not Track” feature that lets a user allow its browser to notify web sites that the user does not want to have his or her online activities tracked. Our Sites currently do not respond to such browser-initiated signals.

10. California “Shine the Light” Disclosure

California law requires websites to give residents of California, under certain circumstances, the right to request from us information about the manner in which PII is shared with third parties for their direct marketing purposes. For the avoidance of doubt, we do not share your PII with third parties for direct marketing purposes.

11. State Privacy Laws

12. Data and Internet Security

The Internet is not 100% safe and secure and we cannot guarantee the security of information you share with us. We have taken numerous technical and physical steps to try and prevent any unwanted breaches of our site’s security. This should protect us and your information against the risk of accidental, intentional, unlawful or unauthorised access. It is important that you keep any password confidential and any transfer of information is at your own risk as we are not responsible for your privacy settings or the security measures enabled on any of your operating systems or devices.

If a parent or legal guardian is made aware that a child under the age of 13 has provided us with PII , we ask to be notified at the earliest opportunity on the email address set forth below. We will then delete any information about the child from our files in accordance with our duties and obligations.

As our business develops, we may acquire, merge, or partner with other companies but if we or substantially all of our assets are acquired, or in the unlikely event that we go out of business or file for bankruptcy, user information may be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of ours may continue to use your PII as set forth in this Privacy Policy.
